As per your rights, we inform you how we collect, store, access, and otherwise process information relating to individuals. In this Policy, personal data (“Personal Data”) refers to any information that on its own, or in combination with other available information, can identify an individual.

This policy applies specifically to the Fishbuddy by Fiskher mobile application available on Android and iOS platforms. This Policy does not apply to our website or other services unless explicitly stated.

3. Processing Activities

This Policy applies when you interact with us by doing any of the following:

• Make use of our application and services as an authorized user
• Visit any of our websites that link to this Privacy Statement

4. What Personal Data We Collect

When you use the Fishbuddy by Fiskher app, we collect the following types of Personal Data:

• Account Information: This includes your name, email address, and password.
• Primary Account Information: This includes data collected from your primary account such as your name, email address, profile information, and any other relevant details to provide and improve our services.
• Usage Data: This includes information about how you use the app, your fishing activities, and preferences.
• Location Data: If you opt-in, we may collect GPS data to provide location-based services.
• Payment Information: This includes your billing address, phone number, credit card, debit card, or other payment method, if you make any purchases within the app.

5. How We Collect Your Personal Data

We collect Personal Data from the following sources:

• From You: You may give us your Account Information, Primary Account Information, and Payment Information by registering in the app, making purchases, and using our services.
• Automated Technologies: As you interact with the app, we may automatically collect Usage Data and Location Data with your consent.

6. Purpose and Legal Basis for the Processing of Personal Data

We collect and use your Personal Data with your consent to provide, maintain, and develop our app and services and understand how to improve them.

Where we process your Personal Data to provide a product or service, we do so because it is necessary to perform contractual obligations. All of the above processing is necessary in our legitimate interests to provide the app and services, maintain our relationship with you, and protect our business, for example, against fraud. Consent will be required to initiate services with you. New consent will be required if any changes are made to the type of data collected. Within our contract, if you fail to provide consent, some services may not be available to you.

7. Collection and Use of Primary Account Information

We collect and use information from your primary account to provide and improve our services. This includes:

1. Types of Information Collected:

• Email Address: Used for account creation, authentication, and communication.
• Name: Used for personalized user experience.
• Profile Information: Includes any additional information you provide, such as profile pictures and preferences.

2. Purpose of Collection:

• Authentication: To verify your identity and secure your account.
• Personalization: To customize the app experience based on your preferences and past activities.
• Communication: To send you updates, notifications, and support-related messages.

3. Data Sharing and Disclosure:

• Internal Use: Information is primarily used by our team to enhance user experience and app functionality.
• Third-Party Services: We may share information with third-party services that help us provide and improve our services (e.g., cloud storage providers). These third parties are bound by strict data protection agreements.

4. Data Security:

• Encryption: We use industry-standard encryption to protect your data both in transit and at rest.
• Access Control: Access to your data is restricted to authorized personnel only.

5. User Rights:

• Access and Correction: You can access and update your account information through the app settings.
• Deletion: You can request deletion of your account and associated data by contacting our support team.

8. International Data Transfer and Storage

Where possible, we store and process data on servers within the general geographical region where you reside (note: this may not be within the country in which you reside). Your Personal Data may also be transferred to, and maintained on, servers residing outside of your state, province, country or other governmental jurisdiction where the data laws may differ from those in your jurisdiction. We will take appropriate steps to ensure that your Personal Data is treated securely and in accordance with this Policy as well as applicable data protection law.

9. Sharing and Disclosure

We will share your Personal Data with third parties only in the ways set out in this Policy or set out at the point when the Personal Data is collected. We may also use your Personal Data to provide you with targeted marketing via advertisements or communications (such as newsletters). This may include cross-app tracking and sharing data with advertising partners when you have given consent.

10. Tracking and Analytics

10.1 Fishbuddy uses tracking and analytics technologies to understand how users interact with the app, identify issues, and improve functionality, performance, and user experience.

On iOS devices, Fishbuddy may request permission under Apple’s App Tracking Transparency (ATT) framework to collect certain usage data across sessions for analytics purposes.

Tracking may include the use of device identifiers and usage signals to help us:

• Understand feature usage and navigation patterns
• Improve onboarding, performance, and reliability
• Detect bugs and technical issues

Fishbuddy does not display ads and does not use tracking for targeted advertising.

You are not required to allow tracking in order to use Fishbuddy. If you decline tracking permission, your experience will not be restricted, but we may have less insight into how the app is used.

You can manage or withdraw your tracking permission at any time through your device’s privacy settings:

iOS: Settings > Privacy & Security > Tracking

10.2 With your consent, Fishbuddy may use LogRocket, a third-party analytics and diagnostics service, to record and replay app sessions. These recordings help us identify bugs, understand usability issues, and improve the app experience.

Session recordings may include screen content, taps, scrolling, navigation between screens, and other interactions within the app. If you use the AI fish scanner while session recording is enabled, photos displayed within the app may appear in the recording.

Fishbuddy configures LogRocket to mask passwords, payment screens, and other sensitive information before recordings are stored or processed.

Session recordings are processed on our behalf by LogRocket and may be stored and processed outside your country of residence, including in the United States. Appropriate safeguards are used to protect personal data in accordance with applicable privacy laws.

Session recordings are retained only for a limited period and are automatically deleted when no longer needed for diagnostics and product improvement.

Session recording is optional and is only enabled when you choose to opt in. You can withdraw your consent and disable session recording at any time through the app settings.

11. Legal Requirement

We may use or disclose your Personal Data in order to comply with a legal obligation, in connection with a request from a public or government authority, or in connection with court or tribunal proceedings, to prevent loss of life or injury, or to protect our rights or property. Where possible and practical to do so, we will tell you in advance of such disclosure.

12. Service Providers and Other Third Parties

We may use a third party service provider, independent contractors, agencies, or consultants to deliver and help us improve our products and services. We may share your Personal Data with marketing agencies, database service providers, backup and disaster recovery service providers, email service providers and others but only to maintain and improve our products and services.

13. What are Cookies?

A cookie is a small file with information that your browser stores on your device. Information in this file is typically shared with the owner of the site in addition to potential partners and third parties to that business. The collection of this information may be used in the function of the site and/or to improve your experience.

14. How We Use Cookies

To give you the best experience possible, we use the following types of cookies:

• Strictly Necessary: As a mobile application, we require certain necessary cookies to run our service.
• Preference: We use preference cookies to help us remember the way you like to use our service. Some cookies are used to personalize content and present you with a tailored experience. For example, location could be used to give you services and offers in your area.

We will only retain your Personal Data for as long as necessary for the purpose for which that data was collected and to the extent required by applicable law. When we no longer need Personal Data, we will remove it from our systems and/or take steps to anonymize it.

If we are involved in a merger, acquisition or asset sale, your personal information may be transferred. We will provide notice before your personal information is transferred and becomes subject to a different Privacy Policy. Under certain circumstances, we may be required to disclose your personal information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

We have appropriate organizational safeguards and security measures in place to protect your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. The communication between your device and our app uses a secure encrypted connection wherever your Personal Data is involved. We require any third party who is contracted to process your Personal Data on our behalf to have security measures in place to protect your data and to treat such data in accordance with the law. In the unfortunate event of a Personal Data breach, we will notify you and any applicable regulator when we are legally required to do so.

We do not knowingly collect Personal Data from children under the age of 16 years.

10.2 Avec votre consentement, Fishbuddy peut utiliser LogRocket, un service tiers d’analyse et de diagnostic, pour enregistrer et rejouer les sessions de l’application. Ces enregistrements nous aident à identifier les bugs, comprendre les problèmes d’utilisation et améliorer l’expérience utilisateur.

Les enregistrements de session peuvent inclure le contenu affiché à l’écran, les appuis, le défilement, la navigation entre les écrans et d’autres interactions au sein de l’application. Si vous utilisez le scanner de poissons par IA alors que l’enregistrement de session est activé, les photos affichées dans l’application peuvent apparaître dans l’enregistrement.

Fishbuddy configure LogRocket afin de masquer les mots de passe, les écrans de paiement et d’autres informations sensibles avant que les enregistrements ne soient stockés ou traités.

Les enregistrements de session sont traités pour notre compte par LogRocket et peuvent être stockés et traités en dehors de votre pays de résidence, y compris aux États-Unis. Des mesures de protection appropriées sont mises en place afin de protéger les données personnelles conformément à la législation applicable.

Les enregistrements de session sont conservés uniquement pendant une durée limitée et sont automatiquement supprimés lorsqu’ils ne sont plus nécessaires à des fins de diagnostic et d’amélioration du produit.

10.2 Con su consentimiento, Fishbuddy puede utilizar LogRocket, un servicio externo de análisis y diagnóstico, para registrar y reproducir sesiones de la aplicación. Fishbuddy configura LogRocket para ocultar contraseñas, pantallas de pago y otra información sensible antes de que las grabaciones sean almacenadas o procesadas.

Las grabaciones de sesión son procesadas por LogRocket en nuestro nombre y pueden almacenarse y procesarse fuera de su país de residencia, incluidos los Estados Unidos. Se aplican medidas de protección adecuadas para proteger los datos personales de acuerdo con la legislación vigente.
